5. PROHIBITED CONDUCT AND CONTENT

You agree not to use the Platform to create, upload, transmit, distribute, or store any content or engage in any activity that:

5.1 Absolutely Prohibited Content

• Child Sexual Abuse Material (CSAM): Any content that depicts, suggests, or could be interpreted as involving minors in sexual situations is strictly prohibited. This includes AI-generated content that appears to depict individuals under the age of 18.
• Non-Consensual Content: Content depicting or glorifying sexual violence, rape, or any non-consensual sexual activity.
• Deepfakes of Real Persons: Using the Platform to create adult content depicting identifiable real individuals without their explicit written consent.
• Extreme Violence: Content combining sexual imagery with extreme violence, gore, or torture.
• Bestiality: Any content depicting sexual acts with animals.

5.2 Other Prohibited Activities

• Attempting to bypass age verification systems or content filters
• Sharing account credentials or allowing minors to access your account
• Redistributing or commercially exploiting Platform content without authorization
• Engaging in harassment, threats, or abusive behavior toward other users
• Attempting to reverse-engineer, decompile, or extract our AI models or algorithms
• Using automated systems, bots, or scrapers to access the Platform
• Violating any applicable local, state, national, or international law or regulation

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Platform Ownership

The Platform, including its design, features, functionality, AI models, algorithms, source code, and all related intellectual property, is and shall remain the exclusive property of the Company and its licensors. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited license to use it as expressly provided herein.

6.2 User-Generated and AI-Generated Content

Content generated through the Platform using your prompts or inputs may be subject to certain ownership considerations. Subject to your compliance with these Terms:

• You retain ownership of your original prompts and inputs
• AI-generated output based on your prompts is licensed to you for personal, non-commercial use unless otherwise specified in your subscription tier
• Commercial use rights may be available through premium subscription tiers or separate licensing agreements

6.3 License Grant to Company

7. PAYMENT TERMS AND SUBSCRIPTIONS

7.2 Automatic Renewal

AI-generated content may contain errors, inaccuracies, or unexpected outputs. You are solely responsible for evaluating the appropriateness and accuracy of any AI-generated content before use.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or alteration of your transmissions or data
• Any damages arising from AI-generated content or your reliance thereon

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; (d) any content you submit to the Platform; or (e) your violation of any applicable law or regulation.

11. CONTENT MODERATION AND REPORTING

11.1 Content Monitoring

We employ both automated systems and human moderators to monitor content on the Platform for compliance with these Terms and applicable laws. We reserve the right to review, remove, or disable access to any content that violates these Terms.

15. MISCELLANEOUS PROVISIONS
